Venewer Systems LLC ("VENEWER," "we," "us," or "our") operates venewer.com and the related online store, customer accounts, product-review features, and services that link to this Privacy Policy (collectively, the "Services"). Our store is hosted by Shopify, which provides the commerce platform we use to offer the Services.
This Privacy Policy explains what personal information we collect, where it comes from, how and why we use it, when we disclose it, how long we retain it, and the choices and rights available to you. The information we collect depends on how you interact with us, the features you use, and where you live.
This Privacy Policy does not replace the privacy notices of payment providers, social media platforms, advertising partners, or other third parties that collect information directly from you under their own terms.
1. Personal Information We Collect
"Personal information" means information that identifies you or can reasonably be linked to you. It does not include information that has been aggregated or de-identified so that it cannot reasonably identify you.
Information you provide
· Contact information, such as your name, email address, phone number, billing address, and shipping address.
· Account information, such as your account identifier, profile details, account settings, and saved preferences. Shopify provides customer-account authentication and may process sign-in information.
· Order and transaction information, such as products ordered, order history, returns, refunds, warranty or support requests, and payment status.
· Payment-related information. Payment details are collected and processed by Shopify Payments and other payment providers you select. We generally receive transaction details, payment status, billing information, and limited payment identifiers rather than complete payment-card information.
· Communications you send to us, including questions, support requests, feedback, survey responses, and information or files you choose to provide.
· Product-review content, such as your display name, rating, written review, photographs, or other content you choose to submit. Reviews may be displayed publicly.
Information collected automatically
· Device and network information, such as IP address, browser type, device type, operating system, language, time zone, and device or online identifiers.
· Usage information, such as pages and products viewed, links selected, referring pages, search activity, time spent on the Services, cart and checkout activity, and interactions with site features.
· Approximate location inferred from your IP address. We do not collect precise geolocation through the website unless a feature clearly asks for it and you choose to provide it.
· Cookie and similar-technology information used for store operation, security, analytics, advertising measurement, and preference management.
Information from other sources
We may receive information from Shopify; payment providers; fulfillment, shipping, fraud-prevention, analytics, advertising, social media, product-review, and customer-support providers; and other partners that help us operate the Services. This may include transaction status, delivery updates, advertising interactions, referral information, and information needed to prevent fraud or provide support.
2. How We Use Personal Information
We use personal information to:
· Provide the Services and fulfill our contract with you, including processing orders and payments, arranging delivery, providing order and account notices, handling returns and refunds, and supporting warranty requests.
· Create and manage customer accounts and remember settings or preferences.
· Respond to questions, provide product and technical support, and maintain our customer relationship.
· Operate product-review features and publish the content you choose to submit.
· Maintain, troubleshoot, analyze, and improve the website, checkout experience, products, and Services.
· Measure the performance of our website and advertising and understand how visitors find and use the Services.
· Protect the Services, customers, and our business; authenticate accounts; prevent fraud; investigate suspicious or unlawful activity; and enforce our terms and policies.
· Comply with tax, accounting, product-safety, recordkeeping, legal-process, and other legal obligations, and establish or defend legal claims.
· Support a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction, subject to appropriate safeguards.
VENEWER does not currently send promotional emails or use automated promotional, browse-abandonment, or cart-abandonment email campaigns. Shopify sends transactional or service messages relating to your order, payment, shipment, refund, account, security, or customer-service request. If we later introduce optional promotional email, we will obtain consent where required and provide an unsubscribe option.
3. Cookies and Similar Technologies
We and our providers use cookies, pixels, tags, and similar technologies. These technologies may collect device, usage, and interaction information.
Essential. Required for core functions such as security, account access, shopping-cart operation, checkout, payment, and privacy-preference storage.
Functional. Remember choices and support optional website features.
Analytics. Help us understand traffic and how visitors use the Services, including through Google Analytics.
Advertising. Help measure advertising, limit repetition, build audiences where permitted, and understand whether activity on the Services followed an advertisement.
Where required by law, non-essential analytics and advertising technologies are used only after you provide consent. You can review or change available choices through the Cookie Settings or Your Privacy Choices link on our website. You may also adjust browser settings, although disabling essential cookies can prevent parts of the Services from working.
Where applicable, we treat a legally recognized browser-based opt-out preference signal, such as Global Privacy Control, as a request to opt out of sale, sharing, or targeted advertising for the browser and device that sends the signal.
4. Analytics, Advertising, and Social Platforms
We use Google Analytics to understand website use. Depending on the campaigns we run, we may also use Google Ads, including YouTube advertising, Meta advertising on Facebook and Instagram, TikTok advertising, and Microsoft Advertising to advertise VENEWER and measure campaign performance. These providers may collect information through cookies, pixels, tags, or similar technologies and may receive information about your device, website activity, advertisement interactions, and purchases or other conversions.
We may maintain pages or accounts on YouTube, Facebook, Instagram, TikTok, and other social platforms. If you interact with us through those platforms, the platform processes your information under its own privacy policy. Social media links alone do not give us access to your private social media account.
We do not sell personal information for money. However, the use of advertising technologies may be considered a "sale," "sharing," or processing for targeted advertising under some U.S. state privacy laws. Where those laws apply, you may opt out through Your Privacy Choices, a recognized browser preference signal, or by contacting us.
5. How We Disclose Personal Information
We may disclose personal information to:
· Shopify, which hosts our store and provides commerce, account, checkout, security, and related services.
· Payment providers, including Shopify Payments, PayPal, Klarna, and Affirm, when you choose an available payment method.
· Truemed, if its HSA/FSA payment or eligibility service is offered and you choose to use it. Truemed and independent licensed practitioners in its network may collect eligibility, health, payment, or related information directly from you under their own privacy notices. In that case, we would receive only the information Truemed makes available to confirm eligibility, process the transaction, or support the order.
· Fulfillment centers, warehouses, carriers, customs agents, insurers, and other providers involved in delivering, returning, or protecting an order.
· Website hosting, cloud, security, fraud-prevention, analytics, advertising, account, and technical-service providers.
· Judge.me, which provides our product-review features and may process review content, contact details, order information, and verification information needed to collect, authenticate, moderate, and display reviews.
· Professional advisers such as accountants, auditors, insurers, banks, and legal advisers where reasonably necessary.
· Government authorities, regulators, courts, law enforcement, or other parties when required by law or reasonably necessary to protect rights, safety, and the integrity of the Services.
· A prospective or completed buyer, investor, lender, or successor in connection with a business transaction.
· Other parties at your direction or with your consent.
6. Relationship with Shopify
Shopify hosts our store and processes information about your access to and use of the store to provide and improve its commerce platform, checkout, customer-account, security, fraud-prevention, analytics, and related services. Information submitted through the store is transmitted to Shopify and may be processed by Shopify and its service providers in countries other than your own.

7. Payment and HSA/FSA Services
Payment providers process payment information under their own privacy notices and terms. The payment options available to you can depend on your location, order, eligibility, and provider approval. Klarna and Affirm may conduct identity, eligibility, or credit-related checks under their own policies; VENEWER does not control those decisions.
We do not currently offer HSA/FSA payment or eligibility services. We may offer these services through Truemed in the future. If this option becomes available and you choose to use it, Truemed or an independent licensed practitioner in its network may ask you for health, eligibility, payment, or other sensitive information. That information would be collected directly by Truemed or the practitioner under the applicable privacy notice. A product's potential eligibility for payment or reimbursement through a health savings account or flexible spending account does not guarantee reimbursement. VENEWER does not receive or use information provided through Truemed's health or eligibility review for advertising.

8. Product Reviews and Public Content
If you submit a product review or other content for publication, the display name, rating, review text, images, and other content you choose to provide may be visible to the public. Do not include information in public content that you do not want others to see. We use Judge.me to collect, verify, moderate, and display reviews. Judge.me may receive information needed to identify a verified purchase and operate the review feature. We do not use Judge.me to send automated review-request emails.

9. Legal Bases for EEA and UK Users
If European Economic Area or United Kingdom data-protection law applies, we rely on one or more of the following legal bases, depending on the processing activity:
· Contract: to process your order, payment, delivery, return, refund, account, and requested support.
· Legitimate interests: to operate and improve the Services, prevent fraud, secure our systems, respond to customers, evaluate business and website performance using information lawfully available to us, and manage our business, where those interests are not overridden by your rights.
· Consent: for non-essential cookies, targeted advertising, or other processing where consent is required. You may withdraw consent at any time without affecting earlier lawful processing.
· Legal obligation: to meet tax, accounting, consumer-protection, product-safety, regulatory, and lawful-request requirements.
10. International Transfers
VENEWER is based in the United States, and Shopify and other providers operate globally. Your personal information may therefore be transferred to, stored in, or processed in the United States and other countries whose data-protection laws may differ from those where you live.
Where required, we and our providers use recognized safeguards for restricted transfers, such as adequacy decisions, the European Commission's Standard Contractual Clauses, the UK International Data Transfer Agreement or UK Addendum, or another valid transfer mechanism.
11. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business and transaction records, support warranties, meet tax and accounting requirements, resolve disputes, prevent fraud, and comply with law.
· Order, payment-status, return, tax, and accounting records are generally retained for the period required by applicable financial, tax, and consumer-protection laws.
· Account information is generally retained while the account remains active and for a reasonable period afterward, unless deletion is requested and no exception applies.
· Customer-service and warranty records are retained for as long as needed to provide support, administer the applicable warranty, document resolutions, and manage legal claims.
· Review content may remain published until removed by us or at your valid request, subject to legal and recordkeeping needs.
· Cookie and analytics data is retained according to the relevant tool settings and our business needs, then deleted, aggregated, or de-identified.
When deciding how long to retain information, we consider its amount, nature, sensitivity, purpose, legal requirements, risk of harm, and whether the purpose can be achieved in another way.
12. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No security measure or method of transmission is completely secure, and we cannot guarantee absolute security. Please protect your account credentials and avoid sending sensitive or confidential information through insecure channels.
13. Your Rights and Choices
Depending on where you live and subject to applicable exceptions, you may have the right to:
· Request access to or information about personal information we hold about you.
· Request correction or deletion of personal information.
· Receive a portable copy of certain personal information.
· Object to or request restriction of certain processing.
· Withdraw consent where processing is based on consent.
· Opt out of sale, sharing, or targeted advertising under applicable U.S. state law.
· Appeal our refusal of a privacy request where applicable.
· Lodge a complaint with your local data-protection authority.
You can submit a request by emailing support@venewer.com. You may also use the privacy controls provided on the Services. We may need information to verify your identity and authority. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct identity verification. We will not discriminate against you for exercising applicable privacy rights.
A request may be limited or denied where permitted by law, including when information must be retained to complete a transaction, meet a legal obligation, prevent fraud, protect rights and security, or establish or defend legal claims.
14. Regional Privacy Information
The rights below supplement the general rights described above. They apply only when the relevant law covers VENEWER's processing of your personal information.
Canada
Residents of Canada may request access to personal information under our control, ask us to correct inaccurate or incomplete information, withdraw consent subject to legal or contractual restrictions and reasonable notice, and challenge our compliance. We remain responsible for personal information transferred to service providers for processing. If we do not resolve your concern, you may contact the Office of the Privacy Commissioner of Canada or, where applicable, the privacy regulator in your province.
Australia
Residents of Australia may request access to and correction of personal information and may make a privacy complaint by contacting us. We will investigate and respond within a reasonable period. If you are not satisfied, you may be able to complain to the Office of the Australian Information Commissioner. Personal information may be disclosed to recipients outside Australia, including in the United States, Canada, the United Kingdom, countries in the European Economic Area, and other locations where Shopify and our providers operate.
New Zealand
Residents of New Zealand may request access to personal information we hold about them and ask us to correct it. If we do not make a requested correction, you may ask us to attach a statement of correction where required. You may raise a concern with our Privacy Contact and, after first giving us an opportunity to resolve it, complain to the Office of the Privacy Commissioner of New Zealand. We use contractual and other safeguards for disclosures to overseas providers where required.
Singapore
Residents of Singapore may request access to certain personal data and information about its use or disclosure, request correction, and withdraw consent with reasonable notice, subject to applicable exceptions. We will inform you of the likely consequences of withdrawing consent. Requests and complaints may be directed to our Data Protection Contact below. You may also raise a concern with Singapore's Personal Data Protection Commission.
15. Children’s Privacy
The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, please contact us so we can review and, where appropriate, delete it. We do not knowingly sell or share the personal information of individuals under 16.
16. Third-Party Websites
The Services may link to websites or platforms operated by third parties. Their privacy, security, and content practices are governed by their own policies. A link does not mean that we control or endorse the third party, and we are not responsible for its privacy practices.
17. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes to our practices, Services, providers, or legal requirements. We will post the revised policy on the website, update the "Last updated" date, and provide additional notice where required by law.
